"Where's My DAMN Money!" It's her money. Her case was settled months ago. She wants to know where's her damn money. This was a wrongful death case. We settled this case months ago. The liability was obvious. The damages were not so obvious. The damages needed to be negotiated. There was also a lien. That meant that when dealing with an agency like Medicaid or Medicare, it's critical to negotiate with them in an attempt to reduce the amount of money they are claiming must be repaid. Once that was negotiated, we then needed to prepare papers to submit to the surrogate's court. This surrogate's court is responsible for overseeing wrongful death cases. This surrogate's court is responsible for overseeing how settlement money is distributed to the surviving family members. The surrogate's court is a stickler for having the correct forms and making sure every word and every comma is correctly put in its place. If it's not, the court will bounce back our papers and tell us to redo them. That takes a considerable amount of time. Once the papers are resubmitted, they must then be presented to the judge for approval. That too takes time. When my outraged client called me and asked “Where's my damn money?” this is exactly the explanation I told her. Not being satisfied with my answer, she called the surrogate's court directly. What she learned was that everything I had told her was 100% true. It is often frustrating for the surviving family members to wait for months getting the surrogate's court to approve the final settlement and how the money is to be distributed. These family members have been subjected to enough indignity by having to deal with the death of their loved one as a result of someone else's carelessness.
