Is Evidence of Doctor's Good Conduct Admissible? NY Medical Malpractice Attorney Gerry Oginski Explains http://www.oginski-law.com/library/yo... 516-487-8207 Email: [email protected] The doctor claims he has never been sued before. Therefore, he argues, he shouldn't be responsible in this case. The doctor claims he's never had such a complication before. Therefore, he argues, he shouldn't be responsible in this case. The doctor is involved in community activities and is a 'good' doctor. Therefore, he argues, he shouldn't be responsible in this case. Regardless of a doctor's good reputation and his community involvement, can an attorney make these arguments claiming he is not responsible for your injuries? In other words, can the defense introduce evidence of the doctor's good conduct to show to the jury that he could not have possibly caused this patient her injuries? Let me give you a great example that will help illustrate why the defense cannot use this argument to show they did nothing wrong... Let's assume a police officer pulls you over for speeding. He writes you a ticket for speeding. In your defense, you argue that you have never received a speeding ticket in your entire life. Therefore, you make the argument that since you have never received a speeding ticket before, there is no possible way you could be speeding now. That argument lacks credibility. The same analogy applies to a doctor who tries to use that as a defense in a medical malpractice case here in New York. Watch the video to learn more...
