A review of Gerald Ford's pardon of Richard Nixon highlights the shortcomings, flaws and gaffs of Trump's pardon of Mike Flynn. In fact, we have not yet seen an actual pardon for Flynn, just a tweet and a White House press release full of propaganda and disinformation. Flynn still has an active criminal case pending before Judge Emmet Sullivan. The first thing that should happen is the actual pardon must be examined by Judge Sullivan to determine the nature, scope and timeframe covered by the pardon (just as Judge Amy Berman Jackson required a copy of the actual sentence commutation issued by Trump to his criminal associate Roger Stone that vitiated Stone's prison sentence). Then, Judge Sullivan will have to determine whether he has any legal avenues other than dismissing Flynn's case. Judge Sullivan's decision may be informed by the fact that even Bill Barr testified that it is a crime for a president to pardon someone in exchange for his silence . . .
