ICC Trial chamber V(b) judges have issued a seven day ultimatum to the prosecution to file a notice to either proceed with the case against President Uhuru Kenyatta or withdraw the charges. In their decision declining an indefinite adjournment, the judges say it would not be in the interests of justice to the President nor the victims who want those the responsible held accountable. At the same time they have declined a request by the prosecution, to find the Kenyan government guilty of non cooperation with the court and have them referred to the assembly of state parties for action.
