This happens in civil lawsuits involving car accidents, medical malpractice and even in wrongful death cases here in New York. This pretrial testimony is known as a deposition. It's also known as an examination before trial. It's done in our office. No judge is present. Only you, me, the defense lawyer and a court stenographer are present. There are many instances where the defense attorney will ask a question, and before the injured victim actually answers it, she will turn to me and ask whether we can go in the hallway and speak. You should know that we are always able to speak and have discussions about anything concerning your case, except in the middle of a question. If the defense attorney has asked you a question and you would like to speak to me before answering, you must answer the question as best you can, and only then we can go out into the hallway and talk. If you need to change or modify your answer as a result of our discussion, you can do that.
