That is a nice thought, but it doesn't happen like that. The reality is that the trial judge assigned to your medical malpractice case or your car accident case or your wrongful death case has many other cases he is handling on a day-to-day basis. If your case is on trial for weeks, he still must attend to those cases. In the majority of instances where he has other matters to attend to, he would typically assign his law clerk to handle those status updates and status conferences. However, there are times when litigants in other cases need the judge to intervene in a process called motion practice. The judge may need to hear to oral argument in order to make an educated decision about what to do on their specific legal requests. Other cases may require the judge's personal intervention such as advanced settlement negotiations in an attempt to resolve a case coming up for trial. Based upon the length of time your cases is expected to last, the judge will typically set aside one day or at least one morning each week where he needs to attend to other cases on his calendar. What that means for the litigants currently on trial in front of him, is that they will be no court on that morning or that day. If you expected your case to go day-to-day for five entire days in the week, that is unlikely to happen. In addition, there may be scheduling difficulties with certain witnesses where a doctor or another witness is unable to come into court in the morning and is only available in the afternoon. If there are no other witnesses that can come in that morning, the judge may simply tell the jury to come the next day starting at 2 PM. Scheduling witnesses can sometimes be tricky and cause changes in the trial schedule. Watch the video to learn more...
