We hear many messages about lawyers achieving verdicts, but we never hear anything about what the litigants do during the time that the jury's out deliberating. The attorneys are in the same predicament as the litigants. There is no time limit in which the jury has to reach a verdict. In New York, in civil lawsuits involving medical malpractice, accidents and wrongful death, the jury will remain in their deliberation room and have lunch brought to them each day that they are deliberating. There's a bathroom specifically for the jurors so they need not leave. But for the litigants and the attorneys, it becomes a waiting game.
