The attorneys appear for pretrial conference. The judge wants to know what the settlement posture is. The plaintiff is willing to settle. The defense attorney says he doesn't know. He has to check with his insurance company. The insurance carrier has to check with their in-house doctors to see whether they will begin settlement negotiations. The judge, recognizing an opportunity to possibly settle, agrees to have the attorneys returned in one month. This will be a final settlement conference. The judge warns the attorneys that if they cannot enter into negotiations, he's going to send them out to pick a jury to start the trial. There is no ambiguity here. Come back in one month and give me a status update. If you can begin negotiating, then settle the case. If you have no intention of negotiating, then you're going to pick a jury immediately. One month goes by. The attorneys reappear in court. The judge asks what the settlement position is for the insurance carrier. The attorney notifies the judge that the insurance company has not completed its review. The judge is furious. The judge sends the attorneys out injury immediately. As soon as a jury is selected, trial will begin the following day. The defense lawyer speaks up & tells the judge “But Judge, I'm not ready to try this case...” What will the judge do at that point?
