During the settlement conference, the defense makes an offer to settle. I now come out and discuss with you the defense's settlement offer. We then have a long discussion about the risks and benefits of either accepting the offer or rejecting the offer. However, you are unsure what to do and want the opportunity to speak to the judge to get his or her impression about what he thinks. Will the judge who is supervising your case and overseeing settlement negotiations speak to you? In many instances, the judge will NOT be willing to speak to you, the injured victim. There are many different reasons for this. However, there are some exceptional judges who recognize the value of speaking to a litigant with his attorney present in order to explain the realities of trial to you, the injured victim. Often times a judge who has agreed to speak to an injured victim will explain the harsh reality of going to trial and the risk associated with taking a case to verdict. The judge will take the time to explain that going to trial is fraught with the possibility that they could lose their case and alternatively, if they win, they could be awarded less money than what is currently being offered in settlement.
