EXTRADITION FROM NEVADA Suspected fugitives who flee to Nevada risk being extradited back to the state where they are facing criminal charges. Here are five things to know about the process of extraditing a suspected fugitive from Nevada. 1) If the defendant is in Nevada, then the state where the defendant is wanted – called the home state – gives Nevada an affidavit, judgment, or an indictment that charges the defendant with a crime. At that point, the Nevada governor issues a Governor’s Warrant, giving Nevada police the authority to arrest the defendant. 2) If the police apprehend the defendant, the defendant can elect to waive extradition and willingly go back to the home state. Or the defendant can demand an extradition hearing to protest being transferred back to the home state. 3) Alleged fugitives who demand an extradition hearing are typically held in Nevada without bail pending the hearing.
