In May 2016, the Dept. of Education and the Dept. of Justice, under the direction of the Obama administration, released a "Dear Colleague" letter that provided Title IX guidance, related to the inclusion of transgender students. Affirming the rights of transgender students in federally-funded K through 12 schools and universities across the country, the guidance was applauded by LGBTQ+ activists. However, the guidance was rescinded under the Trump administration in February 2017. The new guidance directed schools, local school districts, colleges, universities, and states to decide the best path forward for their students. This guidance created many challenges and resulted in continued legal challenges to trans-exclusionary views of Title IX regulations. With the change in leadership at the federal level, LGBTQ+ activists, organizations and professional educational associations, expect several changes to Title IX guidance, particularly related to transgender students.
