However what often happen is they are not being discriminated against, they are just been treated differently. For there to be discrimination in the workplace there has to be one of the recognized grounds which are: • Race • Religion • Sex • Gender orientation or • Age There is no claim for discrimination just because you are being treated differently from your mate next door. What you may have a claim for is workplace bullying; you may have a claim for constructive dismissal, if you feel you are intentionally being treated unfairly so they can get you out of the workplace. Remember that the remedy for being treated unfairly in the workplace, or being a bullied or being constructively dismissed is that you take your employer to a tribunal and you might not necessarily want to go through a tribunal because if you file a grievance and that's not generally what cause the problem, but if you take your employer to a tribunal it's generally going to be the end of a beautiful or not quite so beautiful working relationship, so think twice before you go to a tribunal. If you are going to a tribunal because it is so uncomfortable that you can no longer bear to work there and you did leave remember you only have a strict three months time scale to bring the claim in the employment tribunal.
