The impact of the landmark deal between Korea and Japan on Japan′s wartime sex slavery on individual compensation claims will soon be tested in a Korean court. The trial date hasn′t yet been announced,... but the case is based on a request for mediation made in August 2013 by 12 surviving victims, who were also seeking compensation in the amount of 85-thousand U.S. dollars each. The Japanese government rejected the proceedings, and after two more failed attempts at mediation, the Seoul Central District Court accepted a request by the plaintiffs in October of this year... for a formal trial against the Japanese government. In Korea, a trial can proceed without the presence of the defendant. Two of the women have since died, so the case will now proceed with the 10 remaining plaintiffs. During the upcoming trial,... the part of the recent deal between Seoul and Tokyo on the sex slavery issue that says it is ″final and irreversible″ is expected to become a critical sticking point. However, some also speculate the recent deal might not affect the case,... due to precedents set by previous cases concerning the 1965 Korea-Japan Claims Settlement Agreement. In that agreement, Tokyo claims it settled all issues of compensation to victims of forced labor during Japan′s colonial rule of Korea. And in 2012, the Supreme Court of Korea ruled that the 1965 agreement did not cover individual compensation claims brought by people who were forced to serve in the military during the colonial era.
