CHOP'D UP: Death Penalty or Not? Buffalo Shooter's Life in the Balance

The Buffalo shooter, Payton Gendron, has pleaded guilty to hate crimes, including murder and attempted murder, in state court but his federal case is still unresolved. The gunman faces 14 hate crimes under the Shepard-Byrd Act and 13 charges relating to the illegal use of firearms. Over the next few days, the federal prosecutors, including Attorney General Merrick Garland and Assistant U.S. Attorney Joseph Tripi, will decide to either spare the gunman’s life or seek the death penalty. Attorney Chop discusses the current legal procedure of the case, as well as the racial motivations that may be at play in the federal prosecutors’ decision. Gendron killed 10 people and wounded three others on May 14, 2022, at the Tops Friendly supermarket in Buffalo, New York in a hate-fueled, racist massacre. He had three goals, one of which was to not die. It will be up to the federal prosecutors to either allow him to achieve that goal, or not.
