For example, those same people might believe that an attorney who charges $1500 an hour for their time is somehow a better lawyer than an attorney who charges only $250 an hour. Perceptions and reality are different things. When it comes to accident cases and medical malpractice cases and wrongful death cases here in New York, hourly fees do not apply. There is no such thing as hourly fees in State court for these type of injury cases. Why not? Because in these type of injury and accident cases, they are all handled on contingency. That means that the attorney agrees to represent the injured victim and pay all of the upfront expenses in the hope and expectation that they will be successful in recovering compensation for the injured victim. If the attorney is successful, then his fee is a percentage of the amount of money he's able to recover for his injured client. If the attorney is not successful, then he receives no fee whatsoever. In addition, all the money and expenses that he has laid out over the course of the litigation does not get reimbursed to his law firm. Only if the attorney is successful and he receives a percentage, will he also recover all of his expenses that he put in to prosecute the case. An injured victim who tries to distinguish one injury lawyer from another merely based upon the size of his attorney's fee is literally barking up the wrong tree. Every lawyer in New York charges the same fee when handling a car accident case. Every lawyer in New York charges the same fee when handling a medical malpractice case. Every lawyer New York charge the same fee when handling a wrongful death case. That means that if you are trying to gauge an attorney's ability based upon how large his legal fee is, it simply does not apply in these types of accidents and injury cases.
