Defense says capital murder suspect in Harris County deputy’s killing isn’t competent to stand trial

Defense attorneys for Joshua Stewart, the man charged with capital murder in the 2022 shooting death of Harris County Deputy Darren Almendarez, told a judge Thursday that Stewart should be declared mentally incompetent to stand trial. The push to have Stewart deemed incompetent adds a new layer to a case that has already stretched on for nearly four years and is now moving toward a trial date in January.
