The most common standardized field sobriety tests are: the Horizontal Gaze Nystagmus (HGN), walk-and-turn, finger-to-nose, one-leg stand, and Romberg test. These tests do not have objectively verifiable results which allow them to be challenged in court. The field sobriety tests are not necessarily "passed" or "failed", they are simply used by officers to subjectively evaluate if the subject appears under the influence or not. If, in the officer's opinion you seem intoxicated while performing these tests, he or she can arrest you for a DUI. Many of the standardized field sobriety exercises are difficult to perform and require a certain amount of athleticism. Certain studies show that many participants make errors on these tests even while sober. There are always defenses a DUI Lawyer can make for you if you get arrested for DUI.
