Knox | 112 F.3d 802 (1997) The defense of entrapment looks at whether law enforcement induced a normally law-abiding person to commit a crime. So, can a defendant claim entrapment if he immediately agrees to participate in criminal activity as soon as the idea is suggested? This question was at the center of the case of United States versus Knox. Pastor David Brace hired a financial consulting firm when his church fell into debt and was unable to pay its creditors. Brace and his financial advisor, Shannon Knox, met with undercover federal agents posing as potential investors in a money-laundering sting operation. The agents offered Brace a large investment if he was willing to launder proceeds from their drug-trafficking operation. Brace agreed and said he didn’t care where the money came from. Brace had no prior involvement with money laundering or any criminal history, but after he and Knox repeatedly stated their willingness to participate in the money-laundering operation, the agents arranged a series of installment payments. After accepting three of these payments, Brace and Knox were arrested when they arrived to collect the fourth installment. Brace and Knox were charged with four counts of money laundering, and a jury convicted them on all counts. Brace appealed his conviction to the Fifth Circuit, arguing that he was entrapped as a matter of law. Want more details on this case?
