Some would say the evidence. Others would say a particular witness. Yet others would argue that their expert is the most important thing. Some might say that a lawyer's personality would be the most important thing for a jury to consider in a car accident case or a medical malpractice case or a wrongful death case here in New York. The reality is that all of those things have SOME importance. However, that doesn't address THE MOST important thing for the jury to consider during the trial. In fact, this one thing is so important that if there is a lack of it, you, the injured victim, will lose. If your witnesses and the experts that you bring in to support your claim lack this one thing, then you, the injured victim, will lose your trial. If the evidence that you show the jury lacks this one thing, then it is likely that you will lose your trial. After practicing law for more than a quarter of a century (that makes me sound really old) I can tell you with 100% certainty that if your case lacks this one thing, then you will lose at trial.
