Someone is in "MY SPOT" on public land! Hunting Etiquette. what to do when someone is in "your spot"

You should always have a backup plan when hunting on public land. "spots" are 1st come 1st serve. This guy was super respectful and left even though he had every right to stay. What would you do in this situation? I am fully aware that my stand being already set up doesn't give me a claim to the spot. I never thought it did. if you tell me I should have backed out and just left the stand, you are telling me I should have broke the law. It would have been illegal to leave the stand there no matter what type of stand it is. Whatever you do, you are going to have people tell you you did the wrong thing.
