As per the 128th Constitutional Amendment Bill of 2023, also known as the Nari Shakti Vandan Adhiniyam, the provision for reserving one-third of seats for women in the Lok Sabha and State Assemblies will be put into action following a delimitation process based on the first Census conducted after the enactment of the Act. The Lok Sabha passed this Bill on Wednesday, and it will become an official Act once the President grants her approval, which is expected after it passes in the Rajya Sabha later this week. During the Lok Sabha session, Mr. Shah explained that the Census and delimitation procedures would commence promptly after the next general election. However, he did not specify the exact dates for the delayed Census, which has been a subject of uncertainty since 2021 despite the necessary preparations being in place. The most recent Census was conducted in 2011. Initially, the government attributed the postponement of the next Census, which was supposed to occur in two phases in 2020 and conclude by March 31, 2021, to the COVID-19 pandemic. The Registrar General of India (RGI) did not provide any specific reasons for the subsequent delays in the two notifications. Delimitation refers to the process of defining the boundaries of territorial constituencies in a country to account for changes in population. The last delimitation exercise took place in 1976, and the current boundaries of Lok Sabha and State Assembly constituencies were established based on the 2001 Census. The number of seats has remained unchanged since the 1971 Census due to a Constitutional amendment in 2002, which froze delimitation until after the first Census following 2026. Mr. Shah addressed concerns about the Bill's connection to delimitation and the absence of reservations for OBCs (Other Backward Classes) and Muslims. He emphasized that supporting the Bill was crucial, as even without support, the reservation would not come into effect before 2029. He urged the opposition to back the Bill and make a starting point for this significant change. He went on to reassure that after the Lok Sabha elections, both the Census and delimitation would occur promptly, eventually leading to women occupying one-third of the seats in the House and influencing the nation's future. The general election is scheduled for April-May 2024. In her address in the Lok Sabha, DMK MP Kanimozhi expressed concerns about the connection between Census and delimitation, which was frozen until 2026. She worried that this linkage could reduce the representation of southern states and possibly lead to a significant delay in implementing the Bill. She referred to Clause 5 of the Bill, which indicates that the reservation of seats in the Lok Sabha, State Assemblies, and the National Capital Region of Delhi would only take effect after delimitation and Census data became available.
