PRAYER It is therefore, respectfully submitted that on harm, loss or injury 59. (b) That the Cancel of the Public Notice No. DTC/Pension Cell/ 2024/ 1179 dated 04.09.2024 to the extent that it uses the word non-opted employee and in the context of this public notice it should be read as "retired employee". (c) That the Cancel of the Consent Form No. DTC/Pension Cell/ 2024/ 1180 dated 04.09.2024 to the extent that it includes Note binding conditions of para No. 3 & 4. (d) The present consent form can be utilised for the purpose of seeking interim orders and relief form the Court to start disbursement of pension to all applicants with immediate effect pending decision regarding legitimate legal rights of pension from date of retirement. The disbursement of pension from current date has already been decided by the Board. Further the past conduct of DTC is record of frequent change of stand and unlawful actions necessitating the present relief even at this belated stage to stop further financial hardship, harrasment and humiliation leading to fatal injuries as more than 5000 employees have already died which wait for justice and their legitimate and legal rights to CCS pension. The option clause is barred under EPF & MP 1952 as amended in 1988 & 1995 hence a clear case of discrimination (d) Allow the Application for challenging the validity of board resolution No. 3522 of DTC dated 07.09.2024 and consent form vide DTC pension cell/consent form 2024/1180 U/ S 151 of the code of procedure 1908 read with articles 226 and 227 of the Constitut India for Impleadment of 317 Ex- Employees applicants to be ari as a party respondent to in writ petition No. NO. 1712/2013 Titled Delhi Transport Corporation V/s Regional provident fund commissioner Pass such other order or orders as may be deemed fit and proper in the facts and circumstances of the instant case
