All the time we EPS 95 pensioners compare our pension we are getting on salary limited by ceiling with the pension of Govt Emoloyees or even with ministers. Basically comparision can be in between equals and there can be no comparision between we and Govt employees, ministers far away. we were paid salary by our establishment as per service conditions prescribed for us and we were receiving DA when declared by our PSU subsequent to hsving applied to Govt employees. So far pension is concerned, Govt employees are getting pension based on pension scheme applicable to them by virtue of their employment which included DA, not as a mercy of Govt or at a demand by them. We are getting pension based on EPS 95 applicable to us by virtue of our employment in our PSU or private establishment, which does not include DA. Our pension is so meagre because it is not paid based on actual salary our service at a stretch from our coverage under Family Pension Scheme 1971. We never thought of pension payable to us upon our retirement under EPS 95 and never protested against it but remained covered under it throughout our service span. Consequently we became entitled to pension payable under EPS 95 based on contribution on limited salary. EPFO is not paying pension at it's own but we submitted a claim for pension in predcribed forms to EPFO through our employer, and accepted pension based on limited salary though very much on lower side, even much less than Rs 1000/- per month for years together without any grudge. We could not expect pension on actual salary without additionally contributing by our employer on salary exceeding ceiling. We can not say, as many of us react on FB, that pension we are getting is not correctly paid. At the commencement if EPS 95, some employees protested against EPS 95 and the matter was taken to SC where the scheme was declared benefitial as compared to previous FPS 1971. Can anybody of us say that he refused pension based on limited salary, nobody. The fact remains that we, leaving some remote exception, were not even knowing as to how our pension is calculated and whether it is not calculated on actual salary or not. If the pension is paid correctly as per EPS 95 and even accepted by us, why this pension suddenly became as small as to be inadequate to live a normal life creating such chaos & hue. It is the judgment dated 4.10.2016 who received wide publicity and which woke up us to feel that we are not getting worth pension on actual salary, and going back, it was revealed that there are some more judgments in favour of pensioners and we have a strong hope of pension on actual salary, consequently many of us preferred to ripe out advantage of legal position and filed petitions in High courts and fought upto Supreme Court and got pension on actual salary. The litigation has come to a stage where we are waiting for a judgment in review petition pending before SC. By a chance, issue of at least minimum pension for survial of pensioners came up in parliament and a committee headed by Mr Koahiary MP was consrituted to examine this issue. This committee recommended minimum pension as Rs 3000/-with other recommendations, in pursuance of which, Govt declared minimum pension as Rs.1000/- pm from 1.9.2014. Here we feel that minmum pension Rs 1000/- is not adequate to live a common life. With this base of Koshiary Committee report and shoot up cost of living, National Agitation Committee is continuously struggling for rise in minimum pension for us. It is amply clear that minimum pension is a right under EPS 95 but not a right to claim rise in it. Now no pension on actual salary without additional contribution on salary exceeding ceiling (now not payable by employer) and amount representing such contribution is demanded by EPFO in terms of judgment in Gupta case and circular dated 23.3.2017, and paid by us. So friends, where is the chance to compare ur pensuon with Govt employees or ministers? Only you have to see that you make EPFO to demand amount from u for pension on actual salary, how , you have to decide rather than reacting on FB. Just think.
