Expungement Attorney: What You Can Do Now to Be Able to Vacate Your Conviction Later

If you were just convicted of a criminal offense and are not yet eligible to vacate, what steps can you take to put yourself in the best position to be able to do so? This is my advice as a Washington criminal defense attorney. Step number one. Pay your fines, pay your fines, pay your fines. Pay your restitution too, if you have any. They really care about that a lot more than they should. For example, when vacating a misdemeanor, your eligibility to vacate that clog doesn't even start till all of your fines are paid. The second thing you should do is, document your compliance. Make sure that either you or your attorney are regularly filing what is required of you whether that be treatment, AAs’, or electronic home monitoring. You want to be sure to document everything that you've done, and you want to be sure to keep all of those records. The final thing that I would recommend, is to keep an eye on the law and keep in touch with uh expungement attorneys in this arena because things are changing rapidly in terms of eligibility timelines, exceptions. The pendulum really is swinging in the right direction on these types of cases right now so it's something to keep your eye on in case you do have an opportunity to do it sooner.
