However, in Barr versus American Association of Political Consultants, the United States Supreme Court considered whether Congress could carve out an exception for the government to use robocalls to collect government debts. The Telephone Consumer Protection Act was enacted to protect against intrusive and unwanted robocalls. In 2015, Congress amended the act to permit robocalls made to collect debts owed to or guaranteed by the federal government. For example, student loans and mortgages. The American Association of Political Consultants and other organizations sued the United States attorney general, William Barr, claiming that the amendment violated the Free Speech Clause of the First Amendment by favoring debt collection content over non debt collection content. In addition, many plaintiffs argued that the act itself was unconstitutional. The district court, applying strict scrutiny, ruled that the amendment was content based but was necessary and narrowly tailored to achieve the government’s compelling interest in collecting debt.
