In this episode of The Urban Debate, the host Shreya Dhoundial will discuss how the government's "value judgment" that a person's genital determine their gender was rejected by the Supreme Court on Tuesday. The court ruled that there is no such thing as an "absolute idea of a man or an absolute concept of a woman" and that gender is "much more complicated" than one's genitalia. A Constitution Bench led by Chief Justice of India D.Y. Chandrachud was replying to the Centre's claim that only heterosexual marriages between a "biological man and a biological woman" were recognized by legislation, including the Special Marriage Act. Chief Justice Chandrachud said to Solicitor General Tushar Mehta, who was representing the government, "You are making a crucial value judgment that the concept of a biological man and the notion of a biological woman is absolute."
