This term can also mean different things to different people, but the reference is to a precedent that cannot and should not be overturned, given how it’s become woven into the fabric of law and society. Precedent on precedent. Judge Kavanaugh has been using this phrase to refer to occasions when a precedent is reinforced by a second important case. Notably, he cites the 1992 Planned Parenthood v. Casey case, which reaffirmed the right to abortion established by Roe v. Wade in 1973. Stare decisis. This is a term that refers to courts’ need to respect precedent. It reflects the notion that stability in the law is an important principle that can sometimes trump overturning an opinion, even if a judge believes it was wrongly decided. Original meaning. This refers to interpreting the Constitution by trying to determine how its provisions were understood at the time they was written. There is enormous debate in the legal community on whether this is possible or desirable. Textualism. Similarly, this means interpreting a statute by looking at the direct meaning of its words, rather than relying on lawmakers’ apparent purpose or intent when they enacted it.
